Mediation is a process by which a mediator attempts to "facilitate" the parties to a dispute to reach an amicable and potentially mutually-beneficial agreed resolution to their dispute. 

Mediation is a confidential process (with the exceptions that a mediator is a required reporter of abuse and could also be called to testify regarding any crimes they may witness).

A mediator can also act in an "evaluative" capacity, to assist the parties by directing them to a settlement.

Although the mediator is an attorney, the mediator is not acting in the capacity as an attorney or advocate for either side.  Rather the parties will be encouraged to bring any tentative agreements, termed as a "memorandum of understanding" to their respective attorneys for final review, and to prepare and submit the memorandum of understanding into a legal document that can be filed with and enforced by the courts.

In the alternative, the parties may opt to retain a neutral law office to act as a "third party neutral" to process the divorce or custody paperwork to final completion.
